A booking is made once payment is received.
For portrait sessions, fashion shoots or commercial/product shoots (non-event booking), the full session fee must be paid in advance at the time of booking.
For event coverage, 50% of the agreed fee for the level of coverage must be paid at the time of booking and the remaining 50% before 30 days prior to the event. Where the booking is made less than 30 days from the event, then the whole fee must be paid at the time of booking.
For wedding photography packages, 50% of the agreed package fee (including any addons) must be paid at the time of booking and the remaining 50% before 60 days prior to the event. Where the booking is made less than 60 days from the wedding, then the whole fee must be paid at the time of booking.
See current pricing for specific services and products. When you make a booking you must agree to these general terms and conditions and the image usage and licensing terms.
Once a booking is made, you may request to alter the date up to 30 days prior to the booked date. For portrait sessions, this is subject to a 10% session cost charge, providing the new requested date can be accommodated. Date amendments requested between 30 and 7 days before the booked date are subject to a 60% change fee (providing an alternative date can be found) to cover potential lost bookings. No date changes are accepted after 7 days prior to a booked date.
For events or weddings, you may request to alter the date before 60 days prior to the booked date, subject to a 20% package cost charge, the new requested date being available and the full remaining fee being paid at the time of amendment.
After a portrait session booking is made it may be cancelled by you up to 30 days prior to the booked date, subject to a 20% cancellation fee.
Event and wedding photography deposit payments are non-refundable where you wish to cancel a booking. Where the full payment is made before 60 days prior to the booked date and a cancellation is requested also before 60 days from the booked date, then a 50% refund will be offered. No cancellation refund is offered after 60 prior to the booked date.
If for some extreme and extenuating circumstances I am unable to keep a booking made by you, I will notify you at the earliest possible opportunity and at your preference either offer a full refund or do my best to arrange the best possible replacement photographer.
Of course it’s unlikely to happen. However, this is the terms and conditions page, where such unfortunate eventualities aught to be considered. With that said, if my property or equipment is damaged either by you or people within your group or event, through negligence, intent, drunken or dangerous behaviour, then you will be expected to fund its repair or replacement. If the nature of a particular event or photo shoot entails a substantial risk to property or equipment, then a deposit may be requested to cover that risk.
I want you to be delighted with the images I create for you and your experience with me as your photographer. And I will do everything I can to make sure that’s the case, before, during and after your session or event. But if by some highly unlikely chance you are not satisfied with the service I’ve provided and I cannot otherwise make it right, then I offer a full refund (minus any travel and hire expenses).
The pricing indicated for images from portrait or event photo shoots/sessions is for personal printing use only for the print resolution files, or online personal use (e.g. professional profiles or social media) for lower resolution files, as supplied in a separate folder for online use. You can print for friends and family, but selling on of the image, prints or other commercial use, including provision of images to newspapers or magazines, online or in print, is not permitted. The print resolution files must not be made available online to anyone but yourself, except for uploading to a professional printing service. Copyright is retained by me, the photographer, Joe Hudson. For specific commercial use licenses, please get in touch.
Copyright remains with me the photographer, that means you can display the print for your personal use, but not as a public or commercial display, unless expressly given permission or granted a licence from me to do so. You can sell a print you’ve purchased, providing the buyer understands that copyright is still retained by me and the print usage restrictions laid out here remain. For example you cannot sell a print for commercial or public display usage. You are also not permitted to scan, photograph or otherwise digitize a print, or to make any online use of such a digitization (e.g. profile or website picture). If you require digital images for online usage, please purchase a license for that use.
The images from a portrait/headshot/fashion/commercial/fine art shoot that I add to a preview or proofing gallery are for you to preview and order from only. They are watermarked and not for sharing or publishing anywhere else (e.g. Facebook, LinkedIn, Tinder, etc), thanks.
Where I create an online gallery for an event or wedding, those images you may download and share as you like for your personal use. Express permission must be given by me for any commercial publication (e.g print or online magazine) of such images though.
Where I share a collage of images from a shoot or portrait session (i.e. not a wedding or event) to Facebook or other social media, you are free to share and tag, but not to download and then re-upload to Facebook or elsewhere. If you want to have an image to use, for instance as your profile or header picture, please purchase an online only license for the image(s) (see pricing) you want to use. This will also allow you to use the image, which you’ll have as a high quality file, on other social or professional networking sites.
Permission to use an image that I’ve created, online (or offline), in any way not specifically permitted above, is not granted without either the appropriate licence or express written permission from me, the photographer.
Essentially, if you derive value from using a well crafted, high quality picture I’ve created, then please respect the service I’ve provided you by paying for the use of the image.
As the creator and sole copyright holder of the images I retain all usage rights, including publishing online and offline for promotional purposes. Unless otherwise agreed beforehand, by arranging to have your photographs taken by me, you are agreeing to those terms. I do also want to make sure your privacy is respected. So an instance where I would seek your further permission to make promotional use of an image from your session would include nudity. If the nature of the images otherwise calls for discretion, this is absolutely something we can discuss before the shoot. Similarly for social media sharing, I will ask first before tagging you.
